Welfare/Public Assistance Fraud

Have you or someone you know been investigated or arrested for Welfare Fraud? If you have received public aid, but either misrepresented income, assets, or the composition of your family, you may be investigated and/or charged with crimes like Perjury (118 PC) or Welfare Fraud (Welfare & Institutions Code 10980).  Perjury is a non-reduceable felony, a crime of moral turpitude, and grounds for deportation and exclusion if you are a non-citizen.  Fortunately, if you are being investigated for Welfare fraud, perjury, or similar crimes, I can help.

In San Diego County, the District Attorney's office has a special unit that deals with Public Assistance Fraud (PAF).  If were receiving government aid, such as Calworks or Calfresh, and the prosecutor has information you used false or fraudulent information to obtain such aid (such as a fake social security number, or falsified declarations), they can prosecute you for several different felony violations.

All PAF and welfare fraud prosecutions in San Diego County are handled out of downtown San Diego Courthouse, and fortunately, the court and DA do have a Diversion program available to some defendants whereby if a client admits to certain charge or charges, but agrees to repay the restitution amount, upon repayment, in many cases the case can be dismissed.  This can be a great help to persons who may otherwise be deport-able, or be denied future benefits based on a conviction.
