Felony DUI with Serious Injury, Reduced to simple Misdemeanor in Vista

Client driving home from Boar's Crossing in Carlsbad, rear-ends an elderly person on the Sr-78 Freeway near the Melrose exit. Bodily injury to the person in the other car made it a felony DUI, client's BAC was over .10.
Client is a DACA recipient, so a felony conviction would be devastating. By showing the hard work and education he achieved, as well as his lack of record and community service, we convinced the DA to reduce the charges, not only from a DUI with injury (felony with 1 year mandatory license suspension and mandatory custody) to a simple DUI (no custody, no actual license suspension). Client may still have challenges with immigration, but happy to avoid an aggravated felony, mandatory custody and mandatory year license suspension.
