In response to the California Supreme Court's Previous Emergency Order Shutting down all non-essential court proceedings, and at the specific request of the LA Superior Court presiding judge, LA county Superior Court has been ordered to continue its shut-down until at least May 12, 2020.
What if I have a court Date Scheduled During the Shut Down?
If you have a criminal court appearance scheduled during the Covid-19 Shutdown, and have not-yet appeared in court, you should receive notification by mail of a new court date. If you posted bail for release prior to the Shutdown, I recommend contacting your bondsman to ensure them you are "on it", but they will not have any more information concerning the new court date, at least at this point. If you have a private attorney already retained, you should contact them for additional information regarding your next court date, but at this time, LA, Orange County, and San Diego Courts have not implemented a specific re-scheduling procedure, so everyone will have to be patient as the pandemic quarantine progresses.
How can the Shut-Down Benefit my Criminal Case?
Legally, your liability, charges and defenses have not been altered at all by the Covid-19 pandemic. Practically, many people who would have been arrested and held in jail, or had significant bail set, have already been, or are in the process of, being released. However, current bail status and ultimate resolution of a case are entirely independent. From a realistic standpoint, the prosecutors in all courts will have to contend with a backlog of delayed cases, along with all the new cases being filed, so we are optimistic there will be some Corona-deals to be made once the courts re-open, and the Judges, DA's and defense attorneys strive to clear the backlog.
